Fee for Trademark in India

Before filing an application for Trade Mark, we suggest a search of the Trade Mark database to confirm that the name is available.

A search for ONE name would cost (A) US$ 25, and a search for FIVE names, given together, would be US$ 50. Once the name is available, the application is to be filed.

We charge (B) US$ 150 for FILING one Trade Marks application for one class. This includes the Attorney fees and administrative fees.

The Official filing fee for ONE application in ONE class is (C) US$ 55.

Thus the total filing fee for ONE application in ONE class would be (B) US$ 150 + (C) US$ 55 = US$ 205.

There shall be NO further fee till registration unless there is an OPPOSITION or a HEARING. The fees for attending a HEARING shall be US$ 30 and for responding to opposition shall be US$ 150 for each opposition.

Once we get an notification of registration from the Trademark office then attending to getting the certificate, handling and postage fees would be (D) US$ 150.

The total fee, from search to registration, for ONE application in ONE class comes out to be:
           (A) US$ 25 + (B+C) US$ 205 + (D) US$ 150 = US$ 380 
in case there being NO hearing and NO opposition. Please note that all fees include the Attorney fees, administrative fees and the Official filing fees.

Thus to summarize the total fee is:

    Search      US$25
    Filing      US$ 205
    Registration      US$ 150
    Total      US$ 380

There is NO yearly renewal fee for first TEN years.

It usually takes 15 months to get a registration, in the meantime you are permitted to write TM besides the mark.

We would need the applicant name and address to prepare the POWER OF ATTORNEY(POA) form as per the requirements of Intellectual Property office of India; we shall then send the POA for signing to you.
